Just because the Ocean Shipping Reform Act went into effect in June 2022 doesn’t mean this legislation is on “auto-pilot” and that it can now be treated as a static part of the regulatory landscape. To the contrary, the provisions of OSRA 2022, though implemented on an immediate basis, nevertheless need time to play out in the real world. Several other elements of the law feature lengthy phase-in periods and/or final ruling requirements. This TPM Academy session will analyze the key elements of OSRA 2022 and delve into how the law has driven carrier and NVOCC behavior in areas such as invoicing requirements for demurrage and detention and charge complaints, as well as how the Federal Maritime Commission has performed in enforcing its provisions. As part of a comprehensive treatment of this subject matter, we will also review the status of developing topics such as weekend detention and how OSRA 2022 may adapt to ever-changing market requirements in the future.
